Racial Equity at EVA

Holding racial equity with special consideration is crucial in our school. To understand fully what racial equity means for our school, here’s how we’re ensuring that each and every student can reach their full potential. We are committed to:
  • Implementing programs to enroll all students and regularly engage families, especially those who have not had access or have not been attending;
  • Strengthening high-quality, culturally-sustaining and revitalizing instruction, leadership, and pathways to graduation and post-secondary transitions;
  • Creating access to well-rounded education by centering student learning that builds on strengths, addresses needs, provides active engagement, and is culturally responsive and developmentally appropriate;
  • Providing mental, social, & emotional health supports for students and staff with culturally responsive trauma-informed care, social emotional learning (SEL), racial equity and anti-racist approaches, and a strengths-focused multi-tiered system of support;
  • Safeguarding student opportunity in recognition of the disproportionate and severe impact of the pandemic and our response on students and families; and
  • Serving students in transition from one program to another (kindergarten, 6th, & 9th grades) so they feel a sense of support and belonging in order to overcome any fear and isolation.

The school uses the practices found in Culturally Responsive Teaching, not to be confused with Critical Race Theory. Culturally Responsive Teaching is an approach that makes sure educators affirm students’ cultural, linguistic, and racial backgrounds in order to ensure access to high levels of intellectual and social-emotional learning.

We have received questions from the community about our school’s anti-racism curriculum and whether Critical Race Theory is part of our curriculum. Critical Race Theory is the idea that racism isn’t only the product of an individual’s bias or prejudice but is actually embedded in systems, policies, and institutions, whether that be business, politics, healthcare, housing, or even schools.

Critical Race Theory is not a curriculum at the Evergreen Virtual Academy. However, it can be a lens that our School Board, staff, or students may apply when discussing issues around race and racism.

EVA prohibits the use or display of any symbols of hate on school grounds or in any school-sponsored program, service, school or activity that is funded in whole or in part by monies appropriated by the Oregon Legislative Assembly, except where used in teaching curriculum that is aligned to the Oregon State Standards. We define “symbol of hate” as a symbol, image, or object that expresses animus on the basis of race, color, religion, gender identity, sexual orientation, disability or national origin including, the noose, swastika, or confederate flag and whose display:
  1. Is reasonably likely to cause a substantial disruption of or material interference with school activities; or
  2. Is reasonably likely to interfere with the rights of students by denying them full access to the services, activities, and opportunities offered by a school.

EVA uses administrative regulation ACB-AR – Bias Incident Complaint Procedure to process reports or complaints of bias incidents.

A “bias incident” means a person’s hostile expression of animus toward another person, relating to the other person’s perceived race, color, religion, gender identity, sexual orientation, disability or national origin, of which criminal investigation or prosecution is impossible or inappropriate. Bias incidents may include derogatory language or behavior directed at or about any of the preceding demographic groups.

Child Find Policy

We’re committed to helping students with special needs access the resources they need to learn, grow, and thrive.

District Procedures

As a public charter school within the North Bend School District (NBSD), Evergreen Virtual Academy abides by NBSD’s child identification procedures.
North Bend School District uses an ongoing system to locate, identify and evaluate all children birth to 21 residing in the district, including children with disabilities who are homeless, wards of the state and children attending private schools, suspected of being eligible for special education unless these children are no longer entitled to a free appropriate public education under OAR 581-015-0600 to -0602. This ongoing system includes:

  1. Public awareness activities (e.g., local media resources including television, radio or newspaper; direct contact activities in the community, including presentations at community meetings, business group meetings and other meetings; outreach to those who may not understand English or who may live in rural or isolated areas);
  2. Before any major child find activity, the district will publish notice in newspapers or other media, or both, informing parents that confidentiality requirements apply to these activities. Circulation for this notice must be adequate to inform parents within the district;
  3. A system in each school, public charter school and public alternative school in the district to ensure that:
    1. District staff are knowledgeable of the characteristics of disabilities and appropriate referral of students suspected of having disabilities; and
    2. Special education referrals from parents, teachers and others, including state agencies, are directed to appropriate special education staff.
  4. The district provides information on special education services in the district and the district’s special education referral process to facilities located in the district, including private schools, day care centers, homeless shelters, group homes, county jails, hospitals and other facilities that serve children birth to 21 years old;
  5. The district provides information on special education services, and how to make a referral, to any migrant education programs operating in the district.


The Evergreen Virtual Academy is responsible to locate, evaluate and serve children with special education needs. Healthy and Safe Schools

Healthy and Safe Schools Plan Introduction

In 2017, the Oregon State Legislature passed SB 1062, which requires that, every school district, education service district, and public charter school develop a Healthy and Safe Schools Plan (HASS Plan). Each organization’s HASS Plan has specific requirements that must be included for the HASS Plan to comply with state law. Additionally, each school district, education service district, and public charter school is required to certify annually that the organization continues to comply with the requirements of the HASS Plan by filing an Annual Statement. The following plan was developed to meet these requirements.

Evergreen Virtual Academy does not discriminate and prohibits discrimination in any programs or activities on the basis of protected class, including age, disability, national origin, race, color, marital status, religion, sex, sexual orientation, or gender identity. Complaints and/or inquiries may be directed to the appropriate Coordinator as listed below, and/or may be referred to the U.S. Department of Education Office for Civil Rights (OCR).
